Terms of Service (Conditions Générales de Vente)

This website presents artworks available directly from the artist’s studio.
Each piece is photographed, documented, packaged, and shipped personally by the artist. Purchasing an artwork here is not simply a commercial transaction; it is a direct way of supporting an independent artistic practice and the continuation of the creative process. Thank you for approaching this exchange with the same care and consideration with which the artworks are made.

1. Seller Information

This website is operated by:

Aura Delamotte Barrera. Auto-entrepreneur registered in France. Siret Number: 10052906400014. TVA non applicable, article 293 B du CGI.

By placing an order through this website, the buyer agrees to the following Terms of Service.

2. Scope

This website offers original artworks created by the artist, including:

  • Original drawings and works on paper

  • Sculptural works

  • Other small-scale artworks produced within the studio practice

  • Hand-painted textile pieces

  • Handmade crochet hats and scarves

Artworks are unique, one-of-a-kind works or produced in very small quantities.

3. Artwork and Description

Every effort is made to photograph and describe artworks as accurately as possible.

However, slight differences in color or appearance may occur between the digital images displayed on screen and the physical artwork due to lighting conditions, photography, or screen settings.

Such variations are considered normal when viewing artworks online and do not constitute a defect.

4. Prices

  • All prices are listed in Euros (€).

  • VAT is not applicable (article 293 B du CGI).

  • Shipping costs are calculated during checkout depending on the delivery destination.

  • Prices may change at any time but will not affect orders that have already been confirmed.

5. Orders

To place an order, the buyer must provide:

  • a valid delivery address

  • a valid payment method

Order confirmation occurs once payment has been successfully received.
A confirmation email will be sent to the buyer.

Placing an order implies full acceptance of these Terms of Service.

6. Payment

Payments are processed securely via:

  • Squarespace Payments

  • PayPal

  • Other payment methods available on the website

The artist does not store payment information. All transactions are processed through secure third-party payment providers.

7. Processing & Shipping

Orders are usually prepared and shipped within 5–10 business days.

All artworks are shipped from France, typically via La Poste.

If express shipping or private courier services (UPS, DHL, FedEx) are required for original artworks, arrangements must be made before purchase by contacting the artist at: studio@auradelamotte.com

8. Delivery

Artworks are delivered to the address provided by the buyer at checkout.

Delivery times may vary depending on the destination and postal service conditions.

Responsibility for the artwork transfers to the buyer once the package has been delivered to the provided address.

The artist carefully prepares and packages each artwork, but cannot be held responsible for delays, customs processing, or incidents occurring during postal transport once the shipment has been handed to the carrier.

9. Right of Withdrawal (EU Customers)

In accordance with European Union consumer law, buyers located in the EU have the right to withdraw from their purchase within 14 days from the date the artwork is received.

The right of withdrawal does not apply to:

  • Made-to-order crochet hats and scarves produced according to selected size

  • Any item made specifically according to the customer’s specifications

For crochet items, returns are accepted only if the size does not correspond to the ordered size.

To exercise this right, the buyer must notify the artist by email within the 14-day period.

Returned artworks must:

  • be unused and in their original condition

  • be properly packaged to ensure safe return

Return shipping costs are the responsibility of the buyer.

10. Returns

Returned original artworks should be shipped using a tracked and secure shipping service (signature required delivery). other artworks as textile hand-painted pieces can be shipped using a tracked and secure shipping.

The artist cannot be responsible for artworks damaged during return shipping due to inadequate packaging.

11. Refund Policy

Refunds are issued within 14 days after the returned artwork has been received and inspected.

If the return is approved, the refund will be processed through the original payment method used for the purchase.

Please note that banks or payment providers may require additional processing time before the refund appears in the buyer’s account.

If more than 15 business days have passed since the refund was approved, the buyer may contact the artist at: studio@auradelamotte.com

12. Damaged Artworks

Buyers are encouraged to inspect their package upon delivery.

If an artwork arrives damaged, the buyer must contact the artist within 48 hours of delivery and provide clear photographs of:

  • the damaged artwork

  • the packaging

  • the shipping label

After 48 hours, damage claims may no longer be accepted due to carrier policies.

13. Liability

The artist cannot be held responsible for temporary service interruptions, shipping delays, or circumstances beyond reasonable control (force majeure).

As this website represents a small independent artist studio, all aspects of documentation, packaging, and shipping are handled personally by the artist. Every effort is made to ensure artworks are prepared and shipped with care.

Buyers are encouraged to communicate openly should any issue arise so that a reasonable solution can be found.

14. Governing Law

These Terms of Service are governed by French law.
