Right of Withdrawal (EU Customers)

In accordance with EU consumer law, customers have the right to withdraw from their purchase within 14 days of receiving the item, without giving any reason.

The item must be returned within 14 days after notifying withdrawal.

Return Conditions

  • Items must be returned in original condition.

  • Artwork must not be damaged, altered, or used.

  • Return shipping costs are the responsibility of the customer.

  • The customer is responsible for proper packaging.

Refunds will be issued within 14 days after receiving and inspecting the returned item.

Exceptions (No Right of Withdrawal)

The right of withdrawal does not apply to:

  • Made-to-order crochet hats (custom sizing production)

  • Any personalized or commissioned work

  • Items clearly made according to the customer’s specifications

For made-to-order hats:

Returns are accepted only if the size does not correspond to the ordered size.
Color variations due to screen differences or natural material differences are not considered defects.

2️⃣ DAMAGE DURING SHIPPING (48H CLAUSE)

This is where your 48h rule belongs:

If your item arrives damaged:

  • You must notify me within 48 hours of delivery

  • Provide clear photos of:

    • The damaged item

    • The packaging

    • The shipping label

After 48 hours, damage claims cannot be accepted.

This is reasonable and common practice among artists.

3️⃣ COMMISSIONS (If You Add Later)

If you want to offer commissions later:

Most artists require:

  • 30–50% non-refundable deposit

  • No cancellation after work has begun

  • Final payment before shipping

  • No returns (since personalized)

Legally valid because custom works are exempt from withdrawal rights.

You must clearly state:

"This work is made according to your specifications and is therefore exempt from the right of withdrawal under Article L221-28 of the French Consumer Code."

You cannot reduce the 14 days to 48h.

  • You cannot say “no refunds after 48h.”

  • You can require the buyer to pay return shipping.

  • You can refuse returns on personalized/made-to-order items.

48h is acceptable ONLY for:

  • Reporting damage during transport.

Not for cancellation.

🎨 How Other EU Artists Handle It

Most independent EU artists structure it like this:

For original artworks:

  • 14-day withdrawal right

  • Buyer pays return shipping

  • Artwork must be returned in original condition

  • Refund issued after inspection

For made-to-order / personalized items:

  • No right of withdrawal (legal exception)

  • Only defect/size issues accepted

This is the safest route for you.

Since you’re alone, I recommend:

Processing time: 3–7 business days
Delivery time: depends on country (2–7 days via La Poste in EU)

Better to underpromise and overdeliver.

Clear and human.

Include:

  • Processing time: 3–5 or 5–10 business days

  • Shipping method: La Poste

  • Tracking included or not

  • Shipping zones: European Union

  • Customs (if shipping outside France but within EU → no customs duties)

  • Return address

  • Condition requirements

  • Who pays return shipping

Be transparent that you are a one-person studio.

That builds trust.

Most EU-based artists use:

  • 48h for damage reporting

  • 14 days for withdrawal

  • No returns on custom items

Trying to enforce 48h full return policy would expose you legally.
